1. Introduction

These Terms and Conditions govern your use of my website, purchasing of artwork and services, and all related interactions with Nicole Pletts. By using my services, you agree to comply with and be bound by these terms.

2. Products & Services

I offer original artworks, prints, commissions, workshops, and related services. All products are subject to availability, and we reserve the right to modify or discontinue products or services at any time.

3. Pricing & Payment

Prices are in South African Rand (ZAR). I accept direct deposits and Paystack payments. Payment must be made in full before orders are processed or services rendered.

4. Shipping & Delivery

Shipping costs will be calculated at checkout or quoted separately for commissions. Delivery timelines are estimated and may be affected by courier services or unforeseen delays. I am not liable for delays once the item has been dispatched.

5. Returns & Refunds
Under the Consumer Protection Act:

You may cancel an order within 7 business days of receipt for a refund, provided the item is returned in original condition. Custom or commissioned artwork is non-refundable unless damaged or defective. Refunds will be processed within 14 business days of receiving returned goods.

6. Commissions

Commissioned artworks require a deposit (typically 50%) before work begins. The balance is payable upon completion. Concept approval may be required before finalizing. I retain the right to decline commissions for any reason.

7. Intellectual Property

All artwork, content, and materials provided are the intellectual property of Nicole Pletts unless otherwise agreed in writing. You may not reproduce, distribute, or exploit the content for commercial purposes without written permission.

8. Privacy Policy

I collect and process personal information in accordance with the Protection of Personal Information Act (POPIA). I will not share your data with third parties without your consent, except as required by law.

9. Limitation of Liability

I take care to ensure all products and services meet expected quality standards. However, I am not liable for any indirect, incidental, or consequential damages resulting from your use of our services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be resolved in South African courts.

11. Changes to Terms

I reserve the right to amend these Terms at any time. Updated versions will be posted on our website with the effective date.
